Colby Cosh: Court of Appeal rejects idea that math test is racist

As reported in the National Post on Wednesday, the Ontario Court of Appeal has decided in a unanimous 3-0 decision that a mandatory math exam for Ontario teachers isn’t unconstitutionally racist after all. A couple of months ago, a panel of the province’s divisional court obliterated the exam requirement introduced in 2021 on the basis, still relatively novel in Canadian law, of the “disparate impact” of an ostensibly race-neutral law on Black and Aboriginal teachers.
