After the Supreme Court struck down Roe v. Wade, Democrats lost no time in insisting, all evidence to the contrary, that abortion would swing the midterm elections for them.

Stacey Abrams, after months of dodging and refusing to be pinned down on her abortion views, finally came out and said that, ā€œmy intention is going to be to pass legislation that says a woman has the right to an abortion. And that right continues until a physician determines the fetus is viable outside of the body, except in the case of protecting the woman’s life or health.ā€

Is Dobbs the First Case to Take Rights Away from Americans?

Whatever one may think ofĀ Dobbs v. Mississippi, the Supreme Court decision overrulingĀ Roe v. Wade, some critics have overstated its uniqueness in taking from Americans their preexisting rights. Professor Laurence Tribe badly misinformed his readers when he said the following:

“Friday was a singular day in our history: the first day in living memory that Americans went to bed with fewer inalienable rights than they had when they woke up. Not just in living memory. Ever.”

Tragically, there have been dozens of cases throughout our history in which Americans had their most fundamental rights taken away.

One of the central justifications for the Left’s proposed court-packing scheme is to claim that the reversal of Roe v. Wade is so radically out of step with the American public that it is an undemocratic, minoritarian power grab. Not only is the argument based on the unconstitutional notion that justices should weigh the vagaries of public opinion before ruling but it also relies on the irreconcilable claim that empowering the public to vote on an issue unmentioned in the Constitution is an attack on ā€œdemocracy.ā€

Biden and Garland prepare to get abortion pills everywhere

Abortion pills are likely to become the next major front of the fight over reproductive health care in the wake of the Supreme Court’s decision overturning Roe v. Wade.

Republican-led states have been moving to limit or even completely ban access to the drugs, and advocates worry the Supreme Court’s decision will embolden even more states to crack down.

Immediately following the ruling, Attorney General Merrick Garland said the Justice Department will protect the right to an abortion, including medication abortion.
