As we hurtle toward a resolution of the matter, I am struggling to intuit what the principled case could be in favor of the Supreme Court’s failing to strike down affirmative action this time. It seems to me that, irrespective of one’s preferred judicial philosophy, the logic leads inexorably to the Court’s nixing the practice. Originalist, non-originalist, “living constitutionalist” — whatever. Unless you truly think that the Court ought to just do what you personally prefer — or you think that Americans should be governed indefinitely by an unmoored and unelected Council of Experts — the outcome should be clear, no?

Racial preference programs have become ubiquitous in American society. When was the last time you filled out an official form without being asked to disclose your race? In the name of ending racism, we have been divided and labeled according to vague and outdated racial classifications that are then used to benefit certain groups at the expense of others.

A White student at Howard University’s law school is suing the institution for racial discrimination, alleging the school created a “hostile education environment.”

Michael Newman, the plaintiff, attended Howard University School of Law starting in the fall semester of 2020 and remained there for just two years until he was expelled in September 2022. He is seeking $2 million in monetary damages for “pain, suffering, emotional anguish and damage to his reputation.”

Americans by wide margins don’t want colleges considering race when they pick students — polling that suggests Americans would get behind the Supreme Court overruling affirmative action policies.

A YouGov survey found that 54 percent of adults in the US were against universities considering race as a factor in selecting applicants — even as part of efforts to boost diversity on campus.

That far outweighs the 23 percent who wanted admissions tutors to use race to guide selections, and similar numbers who were unsure. Democrats were much more supportive of affirmative action policies than were Republicans.

The US Supreme Court is set to hear two cases that could dramatically alter the extent to which universities can consider an applicant’s race during the admissions process.

The eventual ruling could end decades-old affirmative action policies and significantly affect how universities manage admissions.
