Be that as it may, it is widely believed that the draft opinion was leaked in order to allow for a pressure campaign to take place in the hopes that some justices could be swayed before the final opinion is released.

Like millions of other Americans, for many years I have waited and prayed for the end of Roe v. WadeRoe’s America has been, for my entire lifetime and then some, what St. Pope John Paul II called, in his 1995 encyclical Evangelium vitae, the “culture of death.” This has been “actively fostered by powerful cultural, economic and political currents which encourage an idea of society excessively concerned with efficiency,” the pontiff wrote, which in turn makes it “possible to speak in a certain sense of a war of the powerful against the weak.” Not just a war. A genocide. This culture of death has sent more than 63 million of my countrymen to a pre-birth grave since Roe (and Doe) gobsmacked America in 1973, just four and a half years before I was born.

Several big-city teachers unions blasted a leaked draft Supreme Court opinion that would overturn the landmark 1973 abortion case Roe v. Wade as racist and oppressive.

In social media statements on Tuesday, the Chicago Teachers Union, the United Teachers Los Angeles union, and New York City’s Unified Federation of Teachers all expressed outrage at Justice Samuel Alito’s leaked draft opinion in Dobbs v. Jackson Women’s Health Organization that was released on Monday by Politico. Some even went as far as to say reversing the abortion decision was racist.

The End of the Road for Roe?

This week, an anonymous leaker violated generations of Supreme Court norms by passing on to Politico a draft decision by Justice Samuel Alito in Dobbs v. Mississippi, the case considering overturning Roe v. Wade (1973). That draft decision, reportedly supported by a majority of the Court including Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett, junks Roe in its entirety, denying the existence of any constitutional “right to abortion”; the majority opinion also trashes Roe’s follow-up case, Planned Parenthood v. Casey (1992), which substituted a vague and unworkable “undue burden” test to determine whether or not a law restricting abortion was unconstitutional in place of Roe’s trimester framework. Alito writes, “The Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. Roe and Casey arrogated that authority.”

The Supreme Court’s integrity demands its leaker be prosecuted — and the decision released now

It would be difficult to cite a higher American public interest than conducting a criminal investigation of the Supreme Court leak. The current security of the justices and the long-term viability of the court as an institution depend on it.

It was entirely appropriate for the court to confirm that Justice Samuel Alito’s draft opinion in the Mississippi abortion case, Dobbs v. Jackson Women’s Health, is not at this point an authoritative ruling of the court. There could understandably be public confusion on that point, so it was incumbent on the court to clarify.

If the draft opinion authored by Associate Justice Samuel Alito stands, it would be a momentous course correction for the court.
